Acceptance of Terms
By accessing or using FrameClaim ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.
Description of Service
FrameClaim is a photo monitoring platform operated by Saints Touch Photography. We run reverse image searches on the images you upload, show you the pages those searches return, and generate draft DMCA takedown notices and licensing demand letters from your account details.
A search result is a page that a search engine associated with your image. It is not a finding of infringement, and we do not check the page before showing it to you. Deciding whether a use is unauthorized is your judgment to make.
FrameClaim does not send anything on your behalf. Every notice and letter is generated for you to copy. You choose the recipient and you send it from your own account. We do not provide legal advice, and use of our generated documents does not create an attorney-client relationship.
User Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information when creating your account
- Only upload images that you own or have the legal right to monitor
- Not use the Service for any unlawful purpose
- Not attempt to circumvent any security features of the platform
- Notify us immediately of any unauthorized use of your account
Intellectual Property
You retain all ownership rights to the images you upload. By uploading images, you grant FrameClaim a limited, non-exclusive license to store, process, and send copies of those images to the search providers we use, solely for the purpose of providing the monitoring service. We do not claim any ownership over your content.
The FrameClaim platform, including its software, design, and documentation, is owned by Saints Touch Photography and protected by intellectual property laws. You may not copy, modify, or distribute our platform without written permission.
Subscriptions and Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you will retain access to Pro features until then. Cancellation runs through the Stripe billing portal linked in your settings; if that link is not working for your account, email us and we will cancel it for you. We reserve the right to change our pricing with 30 days' notice.
DMCA and Legal Notices
FrameClaim provides tools to help you draft DMCA takedown notices and licensing demand letters. These are templates, not legal advice, and they have not been reviewed by a lawyer for your situation. They include statements you are asserting in your own name, including a statement made under penalty of perjury. Read every notice before you send it, and confirm the page really is using your work without permission.
You are the sender. You choose the recipient address, and you are solely responsible for the accuracy and lawfulness of anything you send. Submitting a false DMCA notice may subject you to legal liability under 17 U.S.C. § 512(f). Some remedies referenced in these templates, including statutory damages, depend on facts we do not check — such as whether the work was registered with the U.S. Copyright Office in time. FrameClaim makes no warranty that using our templates will result in removal of content or any particular legal or financial outcome.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted or error-free, that all unauthorized uses of your images will be found, or that the pages we surface are infringing. Monitoring depends on a third-party search index: it can only return pages that index has crawled, and it will also return pages that turn out to be fine.
Limitation of Liability
To the maximum extent permitted by law, Saints Touch Photography shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits, lost data, or missed infringement detections. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time from your Settings page. Upon termination, your data will be deleted in accordance with our Privacy Policy.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Hillsborough County, Florida.
